Guide to Terminate Labuan Work Permit
Labuan company with a minimum paid up capital of RM250,000 (USD 70,000) can apply to Labuan FSA for a two(2) years renewal multiple-entry work permit for their Directors or expatriates of managerial positions to work under their Labuan company. Their dependants can also be included in their application with the Labuan Immigration Department. Basically, there are three (3) categories of Labuan expatriates wanting to terminate their Labuan work permit as follows:
Expatriates resigned from the company and leave Malaysia for good and would like to terminate their Labuan work permit and clear data. Under this category, Labuan Immigration Department will issue Exit Clearance Memo to the expatriates to exit Malaysia.
Expatriates wish to change from their current Labuan work permit to different category of visa such as Malaysia My Second Home visa, Talent Pass, etc. Under this category, the Labuan Immigration Department will clear data in their system to enable the expatriates to apply for a new category of visa.
Expatriates with expired Labuan work permit while waiting for approval by Labuan FSA for another 2 years’ work permit. Under this category, the Labuan Immigration Department will clear data in their system to enable the expatriates to apply for a new category of visa.
Documents to submit to Labuan Immigration Department for the processing are as follows:
- Original Passport
- Inland Revenue Board (IRB) personal tax clearance letter
- Copy of air ticket for Category 1 expatriates
- Copy of visa approval document for the Category B’s expatriates
It advisable to apply for IRB personal tax clearance letter earlier as the processing timeline may take longer. Labuan immigration has stressed that they will only accept processing of termination or data system clearance for the expatriates only after the submission of personal tax clearance of the expatriates is well received.
